Divorce Fixed Fees

wedding ringOur Family Department at Kingsley David is dedicated to family law. Divorce, the dissolution of a civil partnership or separation can often cause conflict. We recognise that each family is different and our specialist family department can guide you through and help ensure the best possible outcome for you and your family. Wherever possible, we seek to reduce the stresses, strains and financial difficulties that can arise when a relationship breaks down.

We offer a fixed fee service which may be of benefit to you to help you to budget at this difficult time. With fixed fees, you know in advance exactly what costs you will incur. We will discuss the options available to you at the time of your initial appointment with us to decide if the fixed fee is best for you.

Divorce – Fixed Fee

Our fixed fee service covers all of the work required to sort out your divorce and will provide you with peace of mind. It is often more cost-effective than if we were to charge our hourly rate. This only covers divorce cases where the proceedings are not defended and with no complicating factors and you are the person applying for the divorce, the petitioner. This may not be a suitable option for you if you also require advice on financial and / or children matters.

As a member of Resolution, we are committed to conduct matters in a constructive and non-confrontational way.

The fixed fee service will cover the services as set out below:

Basic Divorce: £500 plus VAT = £600

This will include the following:

  • Initial one hour consultation;
  • Advice on the divorce petition;
  • Drafting the divorce petition and any supporting documents;
  • Drafting the application for Decree Nisi;
  • Drafting the application for Decree Absolute;
  • Introductory advice on financial matters and mediation. Comprehensive advice will be charged at the fee earner’s hourly rate.
  • You will be responsible for submitting the documents to the Court.

This does not include:

  • Court fees or other out of pocket expenses;
  • Filing the petition with the court;
  • Going to court (This is not usually necessary for either of you).
  • Arranging personal, substituted or dispensing with service of the divorce petition;
  • Amendments to the petition;
  • Correspondence;
  • Detailed advice on financial or children matters other than as stated above.

Managed Divorce: £625 plus VAT = £750

This will include the following:

  • Initial one hour consultation;
  • Advice on the divorce petition;
  • Drafting the divorce petition and any supporting documents;
  • Sending draft petition to your spouse;
  • Advising you on your spouse’s response to the draft petition;
  • Issuing the divorce petition at Court;
  • Check that your spouse has filed the Acknowledgment of Service with the Court;
  • Drafting the application and statement for Decree Nisi;
  • Sending the application and statement for Decree Nisi to the Court;
  • Drafting the application for Decree Absolute;
  • Sending the application for Decree Absolute to the Court;
  • Inform you at each stage of the divorce as to the progression and forwarding important documents to you when they are received from the Court.
  • Introductory advice on financial matters and mediation. Comprehensive advice will be charged at the fee earner’s hourly rate.

This does not include:

  • Court fees or other out of pocket expenses;
  • Going to court;
  • Arranging personal, substituted or dispensing with service of the divorce petition;
  • Amendments to the petition;
  • Correspondence;
  • Detailed advice on financial or children matters other than as stated above.

If you are the respondent, the person receiving the divorce petition, we offer two fixed fee services:

1: £250 plus VAT

  • Reviewing the petition;
  • Carrying out any subsequent negotiations required as a result of the review;
  • Assisting with completing the Acknowledgment of Service.

2: £500 plus VAT

  • Reviewing the petition and dealing with any negotiations arising from it;
  • Dealing with the Acknowledgment of Service through to Decree Absolute;
  • Consultation, whether face to face or by telephone;
  • Completion and submission of relevant forms;
  • Dealing with correspondence from the court;
  • Regularly updating you as to the progress.

As set out above, the fixed fee service only covers divorce cases where the proceedings are not defended and with no complicating factors. This may not be a suitable option for you if you also require advice on financial and / or children matters. If that is the case then we can, of course, discuss alternative options with you.

Whether you are the petitioner or the respondent and it appears that any unforeseen work is required, we may increase our charges. This is something that we would always discuss with you first.
